Catholic Schools can [finally] take a victory lap

[GTranslate]TORONTO – February 25, 2021. Thursday’s Supreme Court of Canada (SOC) decision re the Theodore school question in Saskatchewan offers an insight into constitutionally guaranteed denominational rights and the primacy of the Constitution over subordinate (inferior) legislation.

Le scuole cattoliche possono fare il giro della vittoria

TORONTO – 25 febbraio 2021. La decisione della Corte Suprema del Canada (SOC) di giovedì sulla questione Theodore school nel Saskatchewan offre una panoramica dei diritti confessionali costituzionalmente garantiti e del primato della Costituzione sulla legislazione subordinata (inferiore).

Gli avvocati si affretteranno a “differenziare” le questioni in esame e le conseguenti implicazioni. È quello che sono addestrati a fare, proprio come i critici che “analizzano” frasi e opere letterarie. Sarebbe “un dato di fatto”; ci sono questioni ristrette e implicazioni più ampie in questione. Il SOC le avrebbe soppesate, prima di decidere di NON ascoltare un appello della provincia contro una precedente decisione della Corte d’appello del Saskatchewan (SCA) in materia di scuole cattoliche a Theodore (popolazione 323).
La SCA aveva ribaltato una decisione della Corte di grado inferiore nel 2017 che aveva deciso contro la Theodore Roman Catholic School Division (TRCSD).
